Ampace DOC NO.: 21700A PRODUCT REV B : SPECIFICATION Page 18 of 19 : instructed by Customer,itsaffiliates,contract manufacturers,customer, orenduser intothe Products; Ampace在其产品上结合或使用客户、客户之关联方、分包方、客户或终端用户的设计、指定或指示的材料、 设计、技术或知识产权; 9.4.2the combination,assembly,operation,oruseoftheProductswithmaterials,devices, Parts,orsoftware notsupplid by Ampace; 客户将Ampace的产品与非Ampace提供的材料、设备、组件或软件进结合、组装使用/运行; 9.4.3modifications,disassembly,repair,andrework to theProductsmade by Customerorany thirdParty withoutthe prior written consent ofAmpace; 客户或其他第三人未经Ampace授权而对Ampace的产品进行的修改、拆解、维修或重工; 9.4.4Ampace'smodificationoftheProducts incompliancewiththedesign,specification,requirements,or instructionsof Customer; Ampace依照客户的设计、规格、要求或指示而对其产品进的修改; 9.4.5theclaimoractionarisingfromnon-compliancewiththerequirementsforuse,storage,delivery,assembly,and disposalofthe Products designatedby Ampace; 客户或任何第三未依据Ampace指定的产品使式对Ampace的产品进使或未按照Ampace指定的 标准对产品进行安置、贮存、运输、组装或处理而导致的任何侵权或索赔事项; 9.4.6useofthe Productsoutsidethe scope ofintended useunderthis Document; 客户或任何第三方未依据本产品规格书中约定的使用范围对Ampace的产品进行使; 9.4.7 anydefectthatmayexistbeforetheProductentersthemarketoranydefectthatisunabletobedetected bythe existingtechnology at the time the Product enters market. 引起损害发的缺陷于Ampace产品投流通前即已存在或投流通时的技术平尚不能发现缺陷的存在 的。 9.4.8knockoff orcounterfeit battery/仿制或虚假产品。 9.4.9anyinconsistency betweenserialnumber,modelnumber,andproductcode./产品型号、序列号和产品编码之间存 在不一致。 9.4.10PACKmalfunctionordeteriorationcausedbytrafficaccident./交通事故造成的产品故障或功能衰减。 9.4.11failuretorechargeafterusing PACKforoverthreemonths.使用期间超过三个月未补电。 9.4.12damages caused bydrop/产品跌落造成的损害。 9.4.13damages caused bywater immersionorsealingdamages./由于浸水或者气密性损坏导致电池受损。 9.5Forany product liabilityrelatedclaimraised against Ampace,theCustomer bearstheburden ofprooftoevidencethat (1) theCustomer and its contractors,agents,customers orend usershavefollowedthe requirementsofthis Document, (2)thereis a productdefect,and(3) theaccident,claimorliabilityissolelyanddirectly causedbysuchproduct defect. Ampaceis entitledtorejectanyclaimandbereleasedfromany liabilityintheeventofCustomer'sfailure to meetthe aforesaid burden of proof. 就任何对Ampace提出的有关产品责任的主张或请求,客户需针对以下事项负举证责任:(1)客户及客户的 代理人、外包商、客户或终端户已遵守本产品规格书的要求;(2)产品缺陷存在;(3)意外事故、主张和责 任单独且直接由该产品缺陷所引起。若客户未能证明上开事项之存在,则Ampace有权拒绝任何因此产的 请求并且据此免责。 9.6 Ampace shallhave no liabilityorobligation with respect to any Products which have been subjected to abuse, misuse, improperuse, negligence, accident, alternation,repair or reworkperformedby any unauthorized persons orentities other than Ampace. 对于任何未经授权的个人或非Ampace实体所滥用,不当使用,疏忽,意外,改动,修理或返工的产品, Ampace概不承担任何责任或义务。 9.7NeitherPartyshallbeliableforanyindirect,special,incidental,punitiveorconsequentialdamagesofanykind (including lost profits),rgardlessoftheformof action,whether incontract,tort(including negligenc),trict liailiy or otherwise, even if informedofthe possibility ofsuch damages in advance.
